Terms & Conditions

  1. These General Terms and Conditions apply to all assignments to Equilius.
  2. Equilius may engage third parties to effect the assignment. Sections 7:404 and 7:407subsection 2 of the Dutch Civil Code (Burgerlijk Wetboek) are herewith excluded.
  3. If, in the course of an assignment, an event occurs that could lead to any liability on the part of Equilius, such liability shall be limited to the amount that is paid out in that specific case under the professional indemnity insurance of Equilius, increased by the amount of the applicable deductible (eigen risico).
  4. If Equilius is liable for damages to persons or property, such liability shall be limited to the amount paid out in that specific case under the general professional corporate liability insurance of Equilius, increased by the amount of the applicable deductible (eigen risico).
  5. If, for whatever reason, no amount is paid out under either of the abovementioned insurances, the liability of Equilius shall be
limited to the fees charged over a maximum period of 6 months in respect of the relevant matter.
  6. Claims for damages shall expire after a period of one year from the day following the day on which the client became aware of the damages and of Equilius as the liable party.
  7. If Equilius engages a person not associated with Equilius to perform an assignment from a client, Equilius shall not be liable vis-à-vis the client for any error or omission (fout) made by such person. By instructing Equilius, the client gives Equilius authority to accept on behalf of the client a limitation of liability stipulated by such person.
  8. All our invoices are to be paid within 14 days after the date of issuance in accordance with the conditions and the currency so mentioned on the invoice, unless otherwise agreed in writing. Equilius may invoice you on a monthly basis.
  9. A client that has not timely paid the amounts due will be in default by law.
  10. Out of the amount paid, Equilius is entitled to first settle the costs of collection, then the interest due and finally the outstanding principal amount and current interest.
  11. Dutch law shall govern the legal relationship between Equilius and its clients.
  12. These General Terms and Conditions are in both Dutch and English. In the event of any discrepancy between the Dutch and English versions, the Dutch version shall prevail.
